Tewksbury Township, NJ — A $3.7 million settlement has been awarded to a construction worker, who was injured in a fall from scaffolding in 2005, reported NJ.com.

Jose Moreira, of Mineola, N.Y., was working on a private residence that was under construction by Carlos Peixoto and his wife, Christine Macedo-Peixoto on Parsonage Lot Road in Tewksbury Township when he fell on October 1, 2005.

Moreira’s lawsuit claims that the defendants did not properly erect the scaffolding.

Moreira was never employed by their company, Macedo Construction Co., Inc.—a Raritan Township-based company. But, Peixoto and the other defendants coerced Moreira into saying he was an employee in order to file a workers’ compensation claim.

The lawsuit claims that he had to defend himself against Virginia Surety who filed a lawsuit against him. Virginia Surety paid over $250,000 in benefits to Moreira.

Moreira was also seeking compensation to cover the Virginia Surety lawsuit, in addition to medical expenses from the construction accident.

Moreira was awarded a $3.7 million settlement from the court.
